HUG terms of service.

Introduction:
Welcome to Hug, a mobile application developed by Potato & Tomato Technologies Pte. Ltd. ("Company," "we," or "us"). These Terms of Use ("Terms") govern your use of the Hug app and its services, including but not limited to:

- Check-in schedule and emergency plan features
- User account management
- Data collection and privacy
- Intellectual property rights
- Dispute resolution and limitation of liability

By downloading, installing, or using the Hug app, you agree to be bound by these Terms. If you do not agree, you must not use the app.

User Rights and Responsibilities:
- You must be at least 13 years old to use the app.
- You are responsible for maintaining the confidentiality of your account and password.
- You agree to use the app only for lawful purposes.
- You agree to provide accurate and complete information when setting up your account and emergency plan.
- You are responsible for ensuring that all emergency contact information and plan details are accurate and up to date.

Behavioral Issues Scenarios:
- If your phone is switched off, the app's functionality will be unavailable.
- If your phone is in airplane mode or lacks internet connectivity, the app's functionality may be limited or unavailable.
- If you fail to respond to check-in alerts, the emergency plan may be activated automatically.
- We reserve the right to terminate your account if you provide false or misleading information, or use the app for fraudulent or malicious purposes. Additionally, any fraudulent activity may be reported to relevant authorities.

Intellectual Property:
The Hug app and its content, including but not limited to text, graphics, logos, and software, are the intellectual property of Potato & Tomato Technologies Pte. Ltd. You may use the app's content solely for personal, non-commercial purposes. Any reproduction, modification, distribution, or other use of the app’s content without our express written consent is prohibited.

Data Collection and Privacy:
We collect data to improve the app and provide services. This includes, but is not limited to:
- User account information
- Check-in schedule and emergency plan data
- Device location and usage data

Account Deletion:
Upon the deletion of your account, all data related to your account will be permanently deleted, except for any data that we are legally required to retain.

Dispute Resolution:
Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of the Singapore International Arbitration Centre (SIAC). The arbitration will take place in Singapore, and the decision of the arbitrator will be final and binding. Users agree to waive the right to participate in class actions or jury trials, except where prohibited by applicable law.

Limitation of Liability:
We are not liable for any damages arising from your use of the app, including but not limited to:
- Direct, indirect, incidental, or consequential damages
- Damages for loss of profits, data, or use
- System outages, force majeure events, or user error

This includes any failure to receive alerts or emergency notifications due to user negligence, such as leaving the phone switched off, without internet connectivity, or on airplane mode.

Service Availability and Updates:
We strive to keep the Hug app running smoothly, but there may be times when the app is unavailable due to maintenance, technical issues, or other reasons. We reserve the right to modify or discontinue any feature or functionality of the app without prior notice.

Third-Party Integrations:
The Hug app may integrate with third-party services, such as maps or messaging platforms, to provide enhanced functionality. We are not responsible for the performance, availability, or terms of service of these third-party services.

Governing Law and Jurisdiction:
These Terms are governed by and construed in accordance with the laws of Singapore. Any disputes or claims arising from these Terms will be subject to the exclusive jurisdiction of the courts of Singapore. Users from other jurisdictions are responsible for ensuring compliance with local laws applicable to their use of the app.

Downloading Our App:
When you download our App from the Apple App Store, Google Play, or another app store or app distribution platform (an "App Store"), you acknowledge and agree that:
1. These Terms are concluded between us, not the App Store, and we are solely responsible for the Hug app.
2. The App Store has no obligation to furnish any maintenance or support services for the app.
3. The App Store is not responsible for any claims relating to the app, including but not limited to:
- Product liability claims
- Consumer protection claims
- Intellectual property infringement claims
- Claims of non-compliance with legal or regulatory requirements
4. The App Store is a third-party beneficiary of these Terms and may enforce these Terms against you with respect to your use of the app.

You must also comply with the App Store's terms of service when using the Hug app.

In-App Purchases or Subscriptions (if applicable):
Certain features of the Hug app may require in-app purchases or subscriptions. All purchases are final, and subscription fees are non-refundable. You can manage or cancel subscriptions via the app store where you initially made the purchase.

Changes to Terms of Use:
We may update these Terms from time to time. Any changes will be posted in the app or communicated via email. Your continued use of the app after any updates indicates your acceptance of the revised Terms.

Termination of Use:
We reserve the right to suspend or terminate your access to the Hug app at any time, without prior notice, if you violate these Terms or if we deem it necessary to protect the integrity of the app or its users.

User Feedback:
If you provide feedback, suggestions, or ideas regarding the Hug app, you acknowledge that these are submitted voluntarily and that we may use them without obligation to compensate you.

PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THIS AGREEMENT INCLUDES LIMITATIONS ON DAMAGES AND INDEMNIFICATION OBLIGATIONS YOU MAY OWE TO US. BY USING THE HUG APP, YOU AGREE TO SUBMIT DISPUTES TO BINDING ARBITRATION, RATHER THAN JURY TRIALS OR CLASS ACTIONS, EXCEPT WHERE PROHIBITED BY LAW.
By accessing or using the Hug app, you acknowledge that you have read, understood, and agreed to these Terms.
